Terms & Conditions for the Braemar cash back offer (“Promotion”)

The below terms and conditions refer to the above mentioned Seeley International promotion and do not refer to various gas distributor rebates available for installation of gas appliances and connections. Refer to your gas distributor or retailer for these terms and conditions.

Please read these terms and conditions carefully before proceeding for Braemar cash back promotion:

  1. Instructions and information about how to claim the cash back offer form part of the Terms and Conditions of this Promotion. Participation in this Promotion is deemed to be acceptance of these Terms and Conditions.
  2. The Promoter is Seeley International Pty Ltd ABN 23 054 687 035 (“Seeley International”) (with its principal place of business at 112 O’Sullivan Beach Road, Lonsdale, SA, 5160).
  3. The Promotion will be offered within Australia, to residents who are aged 18 years and over.
  4. The Promotion will commence at 9am A.E.S.T. on 1 April 2024 and conclude by the close of business of Participating Dealers on 30 April 2024 (“Promotional Period”).
  5. All applications to redeem the cash back offer must be made before 5:00pm A.E.S.T. on 11 June 2024 (“Closing Date”). No exceptions will be made for late or incomplete applications.
  6. Employees of Seeley International and its related entities, and Participating Dealers, Retailers, Service Agents or other agencies or businesses associated with this Promotion, and all of their employees (and any spouse, de-facto spouse, parent, guardian, child or sibling of employees of the entities referred to in this paragraph) are all ineligible to claim or redeem the cash back offer.
  7. This offer is only available from a participating dealer (“Participating Dealer”) and excludes purchases through wholesale distributors/trade installers. For a list of Participating Dealers, please visit seeleyinternational.com/promotions

HOW TO CLAIM THE CASH BACK OFFER:

  1. To participate in this Promotion and be eligible to claim the cash back offer, a customer must:

(a) purchase, including any deposit paid, (Note: the deposit paid date is considered the purchase date) either a Braemar 5 Star, 6 Star or 7 Star Ducted Gas Heater from a Participating Dealer during the Promotional Period (“Eligible Product”);

(b) have the Eligible Product installed (by the same Participating Dealer they purchased it from) and paid for in full, on or prior to the Closing Date (refer clause 5 above) of this Promotion;

(c) submit an online application form via Seeley International’s website to redeem the cash back offer prior to the Closing Date of this Promotion; and

(d) on or prior to the Closing Date of this Promotion (to complete the online application to redeem the cash back offer), submit to Seeley International:

(i) a legible tax invoice and a receipt for payment of a deposit, in PDF format only, from a Participating Dealer to verify that the Eligible Product was purchased within the Promotional Period; and

(ii) a legible and paid tax invoice, together with a receipt showing payment in full, in PDF format only, dated on or before the Closing Date of the promotion to verify that the date of installation of the Eligible Product, and date that full payment was made for the Eligible Product, was on or before the Closing Date; and

(e) comply with all of the other requirements set out in these Terms and Conditions.

  1. Where the documentation referred to in Clause 8(d) is insufficient then Seeley International reserves the right to request further documentation to verify that the purchase of the Eligible Product was made within the Promotional Period and that the Eligible Product was installed prior to the Closing Date of the Promotion. Provision of the cash back will be subject to Seeley International being satisfied that these conditions have been complied with.
  2. A claim for cash back can only be made by the customer who purchased and had the Eligible Product installed, and whose name appears on the corresponding tax invoice. (The Participating Dealer who sold the Eligible Product is not permitted to submit an application form on the customer’s behalf, nor is any other person.)
  3. Seeley International shall not accept liability or responsibility for any claims that are not received by Seeley International by the Closing Date, or that are lost (whether in transit or otherwise) or that are otherwise incomplete.

 

CASH BACK OFFER

  1. The cash back offer is;

(a) Braemar 5 Star Ducted Gas Heater $200.00 AUD

(b) Braemar 6 or 7 Star Ducted Gas Heater $300.00 AUD

for each claim accepted by Seeley International.

  1. A customer may submit more than one claim for a cash back provided that: 

(a) only one claim is submitted (and only one cashback will be paid) for each purchase and installation of an Eligible product; and

(b) is a single unit purchase (not multiple units), or if multiple units, limited to one cashback per customer/installation, not per unit; and

(c) each claim is submitted separately and in accordance with these Terms and Conditions.

  1. The cash back is not transferrable or assignable.
  2. Any costs associated with claiming the cash back offer are the responsibility of the customer.

 

PAYMENT

  1. Once a claim has been received and accepted by Seeley International, payment will be made by Electronic Funds Transfer (EFT) into the bank account nominated by the customer on the application form submitted to Seeley International, within 45 days of the completed application being received, verified and accepted.
  2. Making a fraudulent claim is a serious criminal offence. By submitting an application, the customer warrants and represents to Seeley International that:

(a) they are entitled to make the application for the cash back;

(b) the information they have provided to Seeley International in the application is correct, reliable and accurate; and

(c) the bank account details provided in the application belong to the person entitled to apply for the cash back or are provided with that person’s express authority.

  1. By submitting an application, the customer authorises Seeley International to make payment into the bank account they describe in the application form and acknowledges that the payment made in accordance with clause 12 of these Terms and Conditions shall be in full satisfaction of the customer’s entitlement to be paid the cash back.
  2. Seeley International is not responsible for any delays in payment or errors due to factors outside of its reasonable control, including delays or errors in the financial system or errors in the bank account details supplied by the customer on the application form.
  3. By submitting an application, the customer acknowledges that Seeley International is relying on them to provide correct, reliable and accurate information in relation to their bank account and acknowledges that Seeley International shall not be liable or responsible if the customer provides incorrect details and payment is mistakenly made by Seeley International to someone else. The customer accepts this as a condition of the Promotion. If incorrect banking details are provided by the customer and a trace is required to locate the funds, there will be a charge (which varies by banking institution) which shall be payable by the customer.

 

GENERAL

  1. This offer is not valid in conjunction with any other offer or promotion.
  2. Seeley International at its discretion may extend the closing date of the Promotional Period, and the Closing Date for applications to redeem the cash back offer.
  3. Seeley International’s decisions in relation to all aspects of the Promotion and matters pertaining to it are final and binding on each customer/claimant and no correspondence shall be entered into.
  4. Failure by Seeley International at any stage to enforce its rights contained within these Terms and Conditions does not constitute a waiver of those rights.
  5. Seeley International and its related entities, and Participating Dealers, Retailers, Service Agents or other agencies or businesses associated with this Promotion (and the employees, agents, directors and contractors of all entities referred to in this paragraph) shall not be liable for any loss or claim, action, demand, liability, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss) incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance of the cash back offer, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
  6. Seeley International reserves the right to refuse claims, at any time, in the event of non-compliance with the Terms and Conditions.
  7. Seeley International does not warrant that the Participating Dealers will be open at all times during the Promotional Period.
  8. This offer is open only for Braemar 5 Star, 6 Star and 7 Star Ducted Gas Heater models and does not include builder models or commercial models.
  9. The information you submit will be used for the Cash Back Promotion and for the purpose of informing you about our other products and services, including those of our related entities. We may also give your information to retailers, distributors, service agents and other related organisations that may also use it to inform you about their products and services. By taking advantage of the Cash Back Promotion, you consent to having your personal information used in this way. If you wish to gain access to your personal information held by us, please read our privacy policy on our website seeleyinternational.com/privacy-policy and contact the Privacy Officer at Seeley International Pty Ltd, 112 O’Sullivan Beach Road, Lonsdale, SA 5160.
  10. Your personal information will be treated in accordance with the privacy law. Seeley International will take reasonable steps to protect the customer’s information from misuse, interference and loss and unauthorised access, modification or disclosure. However, given that it is impossible to guarantee security, Seeley International is not responsible or liable for any fraudulent use or misuse of your information.

  12. In the event that a term or condition of these Terms and Conditions is found to be invalid, that term or condition shall be severed without affecting the validity of the remaining terms and conditions.
